Senior Manager, Senior Counsel – Consumer Protection, Marketing & Digital Strategy

Capital One’s Legal Department is seeking a high-performing, creative attorney to join our TechReg Legal team as a strategic advisor on consumer protection, brand marketing, and digital innovation. In this pivotal role, you will navigate complex regulatory landscapes to drive enterprise-wide strategy and push the boundaries of what’s possible. You will partner directly with our world-class Brand Marketing and Product teams to build the legal framework for next-generation digital experiences, ensuring that innovation, personalization infrastructures, and consumer transparency go hand-in-hand.

You will join a dynamic, collaborative environment where law and technology intersect, advising on cutting-edge areas such as artificial intelligence (AI), platform architecture, and advanced marketing initiatives. Responsibilities of the role include: 

  • Strategic Product & Lifecycle Advisory: Serve as a lead legal advisor on the lifecycle of breakthrough products and services, from initial concept, design, and customer acquisition through to account management and go-to-market rollout, ensuring customer-centricity and regulatory excellence.

  • Consumer Protection & UDAAP Management: Translate complex UDAAP, marketing, and consumer protection regulations into practical, actionable business strategies that drive growth while safeguarding the brand and the customer. Analyze and mitigate UDAAP risks identified through monitoring and testing, providing clear, actionable guidance to Compliance and Legal partners.

  • Digital & AI Innovation Initiatives: Counsel Brand Marketing and Product teams on digital initiatives, website/app terms and conditions, electronic disclosures, digital signature platforms, and cutting-edge AI implementations.

  • Framework Development: Lead the development, update, and evolution of enterprise-level Legal UDAAP, Consent, and digital frameworks that set the industry standard for compliance and transparent marketing.

  • Marketing & Vendor Support: Act as a trusted partner to the Brand Marketing organization, providing sophisticated counsel on high-profile advertising campaigns and complex vendor negotiations.

  • Regulatory Horizon Scanning: Anticipate and provide proactive leadership on emerging regulatory trends and consumer protection innovations, ensuring Capital One remains at the forefront of the industry.

  • Risk Mitigation & Issue Resolution: Ensure timely identification, mitigation, resolution, and reporting/escalation of existing and emerging legal issues and risks.

  • Stakeholder Collaboration: Build and maintain highly effective working relationships with internal and external stakeholder groups, acting as a critical business partner across business teams, Compliance, and the broader Legal Department.

A successful candidate will have:

  • Strong analytical skills, ability to interpret data, and exceptional attention to detail.

  • Proven skills enabling the provision of innovative and well-grounded legal advice that clearly identifies/describes risks and presents balanced mitigation options, particularly when the law is unclear.

  • Ability to think creatively about how to most effectively and efficiently deliver legal advice and improve current processes, individually and as a team.

  • Excellent verbal and written communication skills with the ability to influence and align diverse stakeholders.

  • Ability to work effectively with minimal supervision in a rapid change environment while managing large volumes of complex legal issues.

  • Demonstrated ability and desire to be a collaborative team player who fosters meaningful relationships and is seen as a trusted advisor and critical business partner.

  • Strong intellectual curiosity, a desire to learn new areas of law, and an interest and ability to analyze and interpret laws, regulations, and other source documents.

  • Passion for and proficiency in using modern technology, with strong organizational and prioritization skills.

Basic Qualifications:

  • Juris Doctor from an accredited law school

  • Active member in good standing of at least one state bar

  • At least 4 years of experience as an attorney in a law firm, in-house legal department, or government agency


Preferred Qualifications:

  • 2+ years of counsel or compliance experience with consumer finance laws, regulations, and disclosures, especially marketing and UDAAP/UDAP laws and regulations.

  • In-house, corporate legal experience in a financial services environment.

  • Comprehensive and thorough knowledge of federal and state consumer protection laws affecting the financial services industry, including but not limited to TILA, TISA, ECOA, UDAAP, FCRA, FDCPA, SCRA, and the Dodd-Frank Act.

  • Financial services industry knowledge and expertise, including experience with business and/or consumer regulatory requirements relating to auto loans, credit cards, lines of credit, loans, and other banking products and services

  • Experience counseling clients on digital initiatives, AI, and/or product innovation.

  • Experience with Google Workspace.

This role is hybrid, meaning associates will spend 3 days per week in person at one of our offices listed on this job posting.

The minimum and maximum full-time annual salaries for this role are listed below, by location. Please note that this salary information is solely for candidates hired to perform work within one of these locations, and refers to the amount Capital One is willing to pay at the time of this posting. Salaries for part-time roles will be prorated based upon the agreed upon number of hours to be regularly worked.

McLean, VA: $200,700 - $229,100 for Sr. Manager, Sr. Counsel

Candidates hired to work in other locations will be subject to the pay range associated with that location, and the actual annualized salary amount offered to any candidate at the time of hire will be reflected solely in the candidate’s offer letter.

This role is also eligible to earn performance based incentive compensation, which may include cash bonus(es) and/or long term incentives (LTI). Incentives could be discretionary or non discretionary depending on the plan.
